RE: The tariff classification of interlining woven fabric from Korea.

Dear Mr. Choi:

In your letter dated November 12, 1993, you requested a classification ruling.

You have submitted five samples of woven fabric identified as style nos. IS-7000, IS-6200, IS-6400, IS-8800 and IS-480LF. Your letter of inquiry states that this merchandise will be used in manufacturing suits. Style no. IS-7000 is composed of 36% staple rayon, 34% cotton and 30% common goat hair. It is plain woven with yarns of different colors and weighs 235 g/m2. The fabric is constructed with 2-ply yarns in the warp. This fabric will be imported in 106 centimeter widths.

Style no. IS-6200 is composed of 47% carded camel hair, 31% cotton and 22% staple rayon. The fabric will be imported in 106 centimeter widths. Weighing 180 g/m2, it is plain woven with unbleached yarns. This textile product is constructed with 2-ply yarns in the warp.

Style no. IS-6400 is composed of 40% staple rayon, 33% cotton, 20% camel hair and 7% common goat hair. It is plain woven with unbleached yarns. The fabric is constructed with 2-ply yarns in the warp and weighs 220 g/m2. This textile product contains 31.4 single yarns per centimeter in the warp and 14.9 single yarns per centimeter in the filling. The average yarn number has been calculated to be 21 in the metric system. It will be imported in 106 centimeter widths.

Style no. IS-8800 is composed of 38% staple rayon, 31% common goat hair, 23% staple polyester and 8% wool. Weighing 200 g/m2, this merchandise will be imported in 106 centimeter widths. It is plain woven with yarns of different colors. This merchandise is constructed with 2-ply yarns in the warp. It contains 31.4 single yarns per centimeter in the warp and 13.3 single yarns per centimeter in the filling. The average yarn number has been calculated to be 22 in the metric system.

Style no. IS-480LF is composed of 47% carded wool, 37% cotton and 16% staple rayon. The fabric weighs 185 g/m2 and it will be imported in 106 centimeter widths. This merchandise is constructed with unbleached yarns. The applicable subheading for style no. IS-7000, will be 5516.43.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for woven fabrics of artificial staple fibers, containing less than 85 percent by weight of artificial staple fibers, mixed mainly or solely with cotton, of yarns of different colors, other, other. The rate of duty will be 17 percent ad valorem. The applicable subheading for style no. IS-6400, will be 5516.41.0050, HTS, which provides for woven fabrics of artificial staple fibers, containing less than 85 percent by weight of artificial staple fibers, mixed mainly or solely with cotton, unbleached or bleached, duck. The rate of duty will be 17 percent ad valorem.

The applicable subheading for style no. IS-8800, will be 5516.93.0090, HTS, which provides for woven fabrics of yarns of different colors, other. The rate of duty will be 17 percent ad valorem.

The applicable subheading for style nos. IS-480LF and IS-6200, will be 5111.90.9000, HTS, which provides for woven fabrics of carded wool or of carded fine animal hair, other, other, other. The rate of duty will be 33 percent ad valorem.

Style no. IS-7000 and style IS-8800, fall within textile category designation 218. Style no. IS-6400 falls within textile category designation 219. Style nos. IS-480LF and IS-6200, fall within textile category designation 410. Based upon international textile trade agreements, products of Korea are subject to quota restrictions and visa requirements. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
